Term of use

I - Purpose

Mégalis Bretagne operates an online solution accessible at mon-compte.bzh (hereinafter referred to as the “Solution”), through which it provides Breton users (hereinafter referred to as the “User”) with a tool for the identification and authentication of Users with partner services of the Solution within the Brittany region, as well as the centralisation of their identification data (hereinafter referred to as the “Services”).

II - Solution operator

The Solution is operated by Mégalis Bretagne, a syndicat mixte de coopération territoriale (local public body for inter-municipal cooperation), registered under number 253 514 491 000 47, with its registered office at 15 Rue Claude Chappe, 35510 Cesson-Sévigné, represented by its President.

III - Acceptance of the Terms of Use

When creating an account, the User must expressly accept these Terms of Use (ToU) in their entirety. Any User who does not accept the ToU will not be able to use the Solution.

IV.    Description of services

4.1 Description of the Services

These Terms of Use define the technical and legal conditions under which Mégalis Bretagne allows Users to create an online account within the Solution, enabling them to securely identify and authenticate themselves with partner services that offer access via the Solution.

The Solution notably allows Users to log in to the mes-services.bzh (nouvel onglet) website, published and operated by Mégalis Bretagne, and to access the related services under the terms set out in the Terms of Use of the “mes-services” website, available at the following link : mes-services.bzh (nouvel onglet).

The User acknowledges and agrees that the Solution only allows authentication with partner services that have signed the Solution’s usage agreement. Mégalis Bretagne shall in no event be held liable if a particular service is not available through the Solution.

4.2 Creating an account on mon-compte.bzh

The User acknowledges and agrees that access to the Services and the creation of an account (hereinafter the “Account”) are reserved for natural persons, acting for their own benefit and/or on behalf of a legal entity.

The User may first create a personal Account on the Solution and, in doing so, must:

• Complete a registration form by providing all mandatory information, including their surname, first name, and email address;
• Choose a password. The User may change their password at any time in the “Settings” section of their Account.

The User acknowledges and agrees that the email address provided during registration serves as their login identifier, which may be changed at any time.

The User may also log in to their Account using the FranceConnect service, with which Mégalis Bretagne is a partner. In this case, the User must use the “FranceConnect” button provided for this purpose. The User acknowledges and agrees that access to their Account via the FranceConnect button is only possible if they meet and comply with the FranceConnect Terms of Use. During the first connection using the FranceConnect button :

• If an Account already exists with the same email address as the one provided by FranceConnect, the User may perform a reconciliation and link their existing Account to FranceConnect.
• Otherwise, a new Account is created, and the User must accept these Terms of Use to finalise the Account creation.

Once an Account is linked to FranceConnect, the User may log in to the Solution using either the FranceConnect button or their Account credentials.

4.3 Security prevention on mon-compte.bzh

To enhance the cybersecurity of users of mon-compte.bzh, the service Ma Santé Numérique.bzh (nouvel onglet), operated by the French company ANOZR WAY, allows users to verify that their personal information (such as email address, password, name, or any other data entered on a website) has not been exposed in databases available on the Internet.

If the user consents to the processing of this data for verification purposes at each login (with a minimum interval of seven days between two checks for the same account), Mégalis Bretagne will communicate the user’s email address to the Ma Santé Numérique.bzh (nouvel onglet) service. A verification is then carried out to determine whether the email address has been compromised. Any detected compromises will be reported to the user of mon-compte.bzh, along with recommended actions to remedy the issue promptly.

The email address transmitted is retained by the Ma Santé Numérique.bzh (nouvel onglet) service for a period of six months following each verification. This service is designed as a preventive and advisory tool for the general public. Individual rights are fully guaranteed, and all appropriate measures have been implemented to comply with the recommendations of the CNIL (French Data Protection Authority) and all relevant legislative and regulatory requirements.

4.4 Services available to Users with an Account

Profile creation and management 

Any User with an Account may create and manage one or more profiles (hereinafter the “Profile”) within their Account, allowing for the personalised provision of services.

A Profile consists of several types of data relating to the User :

• Data voluntarily provided directly by the User;
• Data concerning the User when they choose to connect using FranceConnect, a service provided by the French government;
• Search criteria or services marked as favourites on partner websites, which may also enrich the Profile.

Users may open several Profiles under the following conditions :

• A User may open only one personal (individual) Profile linked to their Account;
• A User may open several association or business Profiles for which they hold valid representation authority.

To create a Profile, the User must first log in to their Account and then click on the “Create Profile” tab. The User must then complete a registration form by providing all the required information.

As part of the preferred partnership with mes-services.bzh (nouvel onglet), the User may, at any time, delete the data stored in their Account to prevent it from being used in the creation of their Service Bundle (the personalised service offering based on the User’s situation).

The User warrants to Mégalis Bretagne that the information provided in the registration form is accurate and not misleading in any way. The User acknowledges and agrees that the information entered for the purpose of creating or updating a Profile constitutes proof of their identity.

The User is also responsible for maintaining the confidentiality of their login details and password, and expressly acknowledges that any use of the Services via their Profile(s) will be deemed to have been made by them personally.

If the User becomes aware that their Profile(s) has been or is being used without their authorisation, they agree to notify the Brittany Region as soon as possible.

4.5 Operation of the Account

The User acknowledges and agrees that their Account enables secure authentication on partner platforms. The User understands and consents that, when using their Account to log in to a partner service, the Solution transmits the personal data required for authentication to that partner platform. This allows the User to benefit from the personalised provision of services. The User may withdraw or modify this consent at any time via the privacy settings of their Account.

V.    Commitments and service level guarantee

Mégalis Bretagne undertakes, under a best-efforts obligation, to ensure the proper functioning of the Services. Mégalis Bretagne also guarantees that its hosting provider implements all necessary technical means and security measures to ensure the protection of data related to the Solution, particularly regarding their availability, confidentiality, and integrity.

The mon-compte.bzh website is accessible continuously; however, its availability depends on third-party systems, as is the case for all Internet-based services. Technological and environmental factors may affect data transmission. In the event of a malfunction of such third-party systems, the Solution may therefore experience temporary limitations or become unavailable, without any liability being incurred by Mégalis Bretagne.

The User acknowledges and agrees that this service level guarantee does not cover any failure or interruption of the Solution caused by third-party systems, including but not limited to telecommunications operators or Internet service providers.

Where necessary, Mégalis Bretagne reserves the right to limit or suspend access to the Solution to perform maintenance and/or improvement operations.

Mégalis Bretagne shall not be liable to the User for the payment of any damages or compensation of any kind — whether direct or indirect, material, financial, or moral — arising from the User’s use of the Services or the Solution.

Mégalis Bretagne shall likewise not be held responsible to the User for any consequences resulting from the occurrence of a force majeure event, including but not limited to those circumstances commonly recognised as such by French courts and case law.

VI.    Intellectual property 

The User undertakes not to commit any act that may infringe upon the intellectual property rights of the Brittany Region in relation to the Solution or its content, whether through reproduction, representation, adaptation, modification, or transformation. Any full or partial reproduction, representation, or adaptation not expressly authorised by the Brittany Region under these Terms and/or not in compliance with the provisions of the French Intellectual Property Code is unlawful and constitutes an act of infringement as defined in Article L.335-3 of said Code.

VII.   User obligations 

Without prejudice to any other obligations set out herein, the User undertakes, when using the Services and the Solution, to comply with all applicable laws and regulations and to refrain from any action that may infringe the rights of third parties or disturb public order.

The User expressly agrees not to use the Services for the following purposes :

• Engaging in illegal, fraudulent, or harmful activities, or any activities that infringe upon the rights or security of third parties. In particular, the User is prohibited from creating an Account in the name of another person and/or using another person’s Account for their own benefit;
• Intruding into a third party’s computer system, or carrying out any activity likely to harm, control, interfere with, or intercept all or part of a third party’s computer system, or to compromise its integrity or security;
• Aiding or encouraging, in any way or form, one or more of the acts or activities described above.

More generally, the User shall refrain from engaging in any practice that diverts the Services from their intended purpose.

It is also strictly prohibited for any User to copy and/or appropriate, for personal use or for the benefit of third parties, the concept, technologies, or any other component of the Solution.

The following actions are also strictly prohibited: any behaviour likely to interrupt, suspend, slow down or otherwise disrupt the continuity of the Services; any intrusion or attempted intrusion into the systems of the Brittany Region; any misuse or diversion of the Solution’s system resources; any action likely to impose a disproportionate load on the Solution’s infrastructure; any interference with or breach of security or authentication measures; any act that could harm the financial, commercial or moral rights and interests of Mégalis Bretagne; and, more generally, any breach of these Terms of Use.

In the event of a breach of any of the provisions of these Terms of Use, or more generally of any infringement of applicable laws and regulations by the User, Mégalis Bretagne reserves the right to :

• Suspend, temporarily or permanently and without delay, the User’s access to the Services in question, whether the User is the perpetrator of or a participant in the breach, particularly in the event of the provision of false, incomplete, misleading, or outdated information during registration;
• Delete any content related to the breach or infringement, in whole or in part;
• Delete the User’s Account;
• Take any appropriate measures and initiate legal proceedings;
• Notify the competent authorities, cooperate with them, and provide all relevant information to assist in the investigation and suppression of illegal or unlawful activities.

VIII.  Disclaimer of liability and warranty 

Mégalis Bretagne undertakes to use its best efforts to provide the Services diligently, it being understood that it is bound by an obligation of means and not of result, which the User expressly acknowledges and accepts. The User further acknowledges that the Services are provided “as is”, without any express or implied warranty of any kind.

Mégalis Bretagne does not guarantee that the Services will be entirely free from defects, errors, or faults.

Under no circumstances shall Mégalis Bretagne be liable to the User for the payment of any damages or compensation of any kind — whether direct or indirect, material, financial, or moral — arising from the User’s use of the Services or of the mon-compte.bzh website.

IX.   Account closure

9.1 Desactivation of the Account

The User may unsubscribe from the Services and close their Account at any time, without providing any justification, by clicking on the “Delete” button within their Account.

9.2 Termination for breach

In the event of a breach by the User of any of their obligations under these Terms of Use, and if such breach is not remedied within fifteen (15) calendar days following receipt of a formal notice to do so, Mégalis Bretagne may, by operation of law and without judicial formalities, terminate these Terms of Use and close the User’s Account.

Termination shall be without prejudice to any damages or compensation that Mégalis Bretagne may claim as a result of the User’s breach, or to any penalties that may be due.

X.    Personal data protection 

As part of the implementation of the Solution’s services, Mégalis Bretagne collects and processes personal data relating to Users.

XI.   Amendments to the Terms of Use 

Mégalis Bretagne reserves the right to modify these Terms of Use at any time. It also reserves the right, at its sole discretion, to amend and/or discontinue all or part of the Services at any time. Users will be informed of any such modifications by any appropriate means at least seven (7) days before they take effect.

If the User disagrees with the new version of the Terms of Use, they may delete their Account at any time.

XII.    Applicable law and juridiction

These Terms of Use are governed by French law, and the French administrative courts shall have jurisdiction to hear any disputes arising in connection with these Terms.
